In consideration of payment of the total sum of: $3,000.00 and the following considerations:

by the Buyers, the Breeder does hereby sell and relinquish one Anatolian Shepherd Dog puppy, Described as follows:

Name: The Breeder shall furnish, upon completion of the terms of this agreement, the AKC Registration Application for this dog. This dog must be registered under LUCKY HIT'S kennel name, with "LUCKY HIT and the Indicated Call Name of the Anatolian Dam" preceding the name chosen by buyer. Buyer may add a name of his choice and append his/her kennel name if sufficient space is available after a name is chosen.
IF, AT ANY FUTURE TIME, THE ABOVE DESCRIBED DOG IS TO BE DISPOSED OF FOR ANY REASON WHATSOEVER (SOLD, GIVEN AWAY, DESTROYED ETC.), THE BREEDER SHALL BE NOTIFIED AND THE BUYER SHALL RETURN THE DOG WITH PAPERS TO THE BREEDER, WITHOUT REIMBURSEMENT, PRIOR TO ANY OTHER DISPOSITION OPTION OCCURING. THE BUYER AGREES TO PAY A $10,000.00 PENALTY FOR FAILURE TO COMPLY WITH THIS SECTION AND ALL LEGAL EXPENSES REQUIRED TO COLLECT THIS PENALTY.
BUYER'S RESPONSIBILITIES:
Every effort has been made by the Breeder to produce a litter both physically and mentally sound. The Breeder will stand behind this breeding to the extent stated below. However, the Buyer accepts full responsibility for the proper care once the pup leaves the Breeder, as the Breeder cannot be held responsible for the death, injury, deformity, or temperament of the pup due to illness, accident or deviation from adequate care and socialization required for a giant-breed (Anatolian) guardian puppy.
Buyer agrees to arrange for adequate veterinary care, including DH-Parvo, monthly heartworm preventative treatment, and rabies inoculations. Annual heartworm examinations are strongly recommended. Feeding high fat, unbalanced supplements, poor quality food and/or overfeeding is detrimental to the health of the Anatolian Shepherd Dog and nullifies the health guarantee for said dog.
BREEDING/SHOW QUALITY PUPPIES BREEDER'S GUARANTEE:
Breeder guarantees that this pup is in good health and will replace any pup that dies or becomes seriously ill from a disease process within seven (7) days of leaving the Breeder, provided there is no negligence on the part of the Buyer. In addition, the Breeder guarantees this pup against hereditary or congenital deformity or dysfunction's as follows:
The Breeder guarantees the above described puppy against congenital or hereditary deformities or dysfunctions documented within 30 months of age which make said animal unfit for breeding. This guarantee in no way implies a guarantee of show/working success for a sound animal, since many factors other than physical soundness determine show/working success.
Examples of such deformity include severe malocclusion or cryptorchidism (in a male.) This guarantee does not cover cosmetic defects. Cosmetic defects do not affect the dog's health, soundness, or working ability. Also, this guarantee does not cover osteochondrosis, or OCD, as the rapid weight gain preceding symptoms requires an abundance of food, an owner-related consideration.

If covered defects do occur, the Buyer has the following options:
1. After the buyer has provided veterinary documentation of the dog's affliction and has received written breeder concurrence with that documentation, Buyer may keep and sterilize (neuter or spay) the afflicted animal. Upon receipt of documentation of the sterilization, the Breeder will replace said animal with a puppy of Breeding/Show Quality, without charge. (Pups will be picked up by the Buyer at the Breeder's location, not shipped.) Such replacement will be made subject to availability and will be made within one (1) year of the date of sterilization or within three (3) months of the arrival of Breeder's first litter after notification or within another time period mutually agreed upon. The sterilized animal need not be returned to the Breeder if kept by the Buyer or placed in another home approved of in writing by the breeder prior to placement.
2. After the buyer has provided veterinary documentation of the dog's affliction and has received breeder concurrence with that documentation, buyer may return the afflicted dog to the breeder with registration papers or, if the dog is dead, a veterinarian certified proof of death agreeable to breeder's veterinarian of the dog's death due to a covered defect. With breeder's veterinarian concurrence that the affliction is as stated after examination of a returned dog or examination of proof death, Breeder will replace afflicted returned or dead dog with a puppy of Breeding/Show Quality without charge. (Pups will be picked up by the Buyer at the Breeder's location, not shipped.) Such replacement will be made subject to availability and will be made within one (1) year of the date of return or death of the afflicted dog or within three (3) months of the arrival of Breeder's first litter after notification or within another time period mutually agreed upon.
All claims must be made within 30 days of determination of the covered defect. If neither of the above alternatives is taken, Buyer agrees not to be party to the breeding of the afflicted dog so long as that dog shall live and the dog will not be replaced by the Breeder.
Determination of hip dysplasia must be made by the Orthopedic Foundation for Animals (OFA) between 24 and 30 months of age. Buyer agrees to furnish Breeder with a high resolution digital copy of the X-rays and the OFA results, whether clear or dysplastic, whenever X-rays are made for OFA determination on this pup.

If the dog has produced, or sired, a litter prior to either the determination of a serious defect or prior to the receipt of OFA certification, the guarantee portion of this contract is null and void.

All claims must be made in writing within 30 days of initial discovery to be considered valid. Venue for any legal action brought pursuant to this contract (or as a result of this contract and/or sale of this Anatolian Shepherd) shall be in Travis County, Texas. Texas law will apply to any such proceeding.
